The task force of the National Council of Justice began this Monday to help the São Paulo Court of Justice organize and find solutions to the problem of court orders. One of the Council's great contributions could be the mediation of a conversation between the São Paulo Judiciary and the state government. The Department of Precatório Depre complains that the state is the largest debtor and has contributed least to the settlement of precatório.
The CNJ's help responds to a request made by the president of the TJSP Ivan Sartori to minister Eliana Calmon. The commission made up of members made a point of highlighting that the Council's action is not an inspection but a partnership that seeks to structure and improve the precatório sector through the analysis of the routines adopted by Depre.
The CNJ team coordinated by assistant judge Agamenilde BTC Number Data Dantas was received by judge Ivan Sartori on Monday morning. He presented the building's facilities in a visit that was accompanied by representatives of the OABSP.
The coordinator of Depre judge Venício Salles explained that one of his biggest difficulties is organizing the lists of creditors as not all municipalities local authorities and the state Treasury sent the necessary data for this. The state government according to him only sent information up to The court does not have information on court orders due from until now. The lack of physical space and servers completes the department's deficiency picture.
Depre provided the commission with a room with computers access to the court order management system and department servers to assist them in their work. The CNJ team will remain at the court until Friday and will present a report to Minister Eliana Calmon on March th.
Last Friday newspapers raised the possibility of bad faith in the delay in payment of court orders in the State. According to a report in the newspaper O Estado de S. Paulo only of the amount deposited by the City of São Paulo for payment of court orders between December and February in a TJSP account was paid to creditors.
Still according to the report creditors protest against the slowness of disbursements and point out possible profitability of the court with the delay in payments. A CNJ rule authorizes courts to sign agreements with official banks to operate special accounts through the transfer of a percentage to be defined in relation to the gains obtained from financial investments made with the amounts deposited.
